The Voting Rights Restoration Act

This legislation will grant the right to vote in local elections, to noncitizen residents in New York City.

The Voting Rights Restoration Act would enfranchise non-U.S. citizens who have resided legally in New York City for more than six months before the time of an election. Lawful residents include legal permanent residents (green card holders), those with spouse visas, and most other kinds of visas. Holders of tourist or other very short-term visas would not be allowed to vote.

Municipal voters would be allowed to vote in city-wide referenda and in primary, special, and general elections including the following offices:

  • Mayor
  • City Council Member
  • Borough President
  • Comptroller
  • Public Advocate
  • Judges

The New York City Board of Elections would create registration forms specifically for municipal voters. It would also create ballots only for municipal –not state or federal– elections.
